These Terms of Service (“Terms”) govern your access to and use of the i spy Service. By downloading, accessing, or using the Service, or by tapping to create an account, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The product itself is the i spy app (iOS and Android). Our marketing website at ispyplatform.com is a landing / support site only — it is not a full web product.

1. Who we are

The Service is provided by I Spy Platform Ltd (company number 17089652), a private limited company registered in England and Wales, trading as “i spy”. Registered office: 167–169 Great Portland Street, 5th Floor, London, England W1W 5PF. Contact: support@ispyplatform.com.

2. The Service

i spy helps you discover fashion inspiration, save products, build boards, and (where available) find shoppable matches via visual search and related features. Product availability, pricing, and stock are controlled by third-party retailers. We may change, suspend, or discontinue features at any time.

3. Eligibility & account

• You must be at least 13 years old (or the higher age of digital consent in your country) and able to form a binding contract.
• You must provide accurate account information and keep it updated.
• You are responsible for activity under your account and for safeguarding credentials and devices.
• One person or entity per account unless we agree otherwise. Do not share accounts or create accounts for others without authority.
• We may refuse, suspend, or terminate accounts for breach, risk, or legal reasons.

4. Licence to use the app

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the i spy apps and sites for personal, non-commercial use (or internal business evaluation if we expressly allow). You may not copy, reverse engineer (except where mandatory law allows), rent, or create derivative works of the Service except as permitted by us in writing.

5. User content

• You retain ownership of content you upload (photos, board text, profile copy, etc.) (“User Content”).
• You grant i spy a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, display, and distribute User Content solely to operate, improve, promote, and provide the Service (including generating embeddings/matches for visual search and showing public boards you set to public).
• You represent you have rights to the User Content you submit and that it does not infringe others' rights or law.
• Public boards and profiles may be viewed by others and indexed as technical design allows. Private boards remain subject to our access for security, support, and legal compliance.
• We may remove User Content that violates these Terms or law, or that creates risk for users or the Service.

6. Acceptable use

• No illegal, fraudulent, harassing, hateful, or sexually exploitative content involving minors.
• No malware, scraping at abusive scale, reverse engineering for competing services, or interfering with the Service.
• No impersonation, account takeover attempts, or circumvention of access controls, paywalls, or rate limits.
• No uploading others' personal data without a lawful basis.
• No use of the Service to spam, phish, or send unsolicited bulk messages.

7. Shopping, affiliates & third-party retailers

• Product listings, prices, currency conversions, and availability may be incomplete, delayed, or wrong. Always verify on the retailer site before purchase.
• Purchases are between you and the retailer (or payment provider). Their terms and privacy policies apply to those transactions.
• We may earn affiliate commissions when you click outbound links or complete purchases. That does not increase your price solely because of us unless a partner discloses otherwise.
• “Find this look”, visual search, and similar features provide suggestions, not guarantees of identical items, authenticity, or stock.

8. Subscriptions & paid features

• Some features may require a paid subscription (e.g. Pro) billed through Apple App Store, Google Play, or another processor we designate.
• Prices, trials, and renewal terms are shown at purchase. Manage or cancel in your store account settings. Refunds are handled under the store's rules unless mandatory law says otherwise.
• We may change paid offerings with notice where required.

9. Communications

• You agree we may send transactional and service-related messages (security, account, legal notices) to your email or in-app.
• Marketing / mail-list emails: by creating an account you are included by default; you can opt out anytime in Account → Email updates or via unsubscribe in any marketing email. See the Privacy Policy. Opting out of marketing does not stop essential service messages.

10. Intellectual property

• The Service, branding, software, models, and design are owned by us or our licensors.
• Retailer product images and trademarks belong to their owners; we display them under licences, fair use, or partner arrangements as applicable. You may not scrape or redistribute catalogue assets outside normal app use.
• Feedback you provide may be used by us without obligation to you.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, accurate matches, or retailer data correctness.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, i spy AND ITS DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) GBP £50. Some jurisdictions do not allow certain limits; in those cases our liability is limited to the fullest extent permitted.

13. Indemnity

You will defend and indemnify i spy against claims arising from your User Content, your misuse of the Service, or your violation of these Terms or law, except to the extent caused by our wilful misconduct.

14. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate access immediately for breach, risk, prolonged inactivity, or legal reasons.
• Sections that by nature should survive (IP, disclaimers, liability limits, indemnity, governing law) survive termination.

15. Changes to the Terms

We may update these Terms. Continued use after the effective date constitutes acceptance of the updated Terms, except where mandatory law requires a different process. If you do not agree, stop using the Service and delete your account.

16. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules, unless mandatory consumer protections in your country of residence provide otherwise. Courts of England and Wales have exclusive jurisdiction, subject to those mandatory rights.

17. General

• If any provision is unenforceable, the remainder stays in effect.
• Failure to enforce a provision is not a waiver.
• These Terms are the entire agreement regarding the Service and supersede prior agreements on the same subject.
• You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or sale.
